Introduction
The US Department of State and the Office of the United States Trade Representative (USTR) recently released an updated draft US model bilateral investment treaty (the 'Draft Model US BIT'). The Draft Model US BIT proposes substantial changes from the US model bilateral investment treaty ('BIT') as last updated in 1994, particularly with respect to investor-State arbitration.
