Abstract
This article focuses on the extent to which renegotiation
clauses deal with the vulnerability of the contractual equilibrium to
disruption, as well as the obsolescing character of the resulting bargain in
international energy investment agreements. Furthermore, it addresses the
taxonomy, function and effect attached to such clauses by international
arbitrations and major legal systems.
