Introduction
p>On February 1, 2006, a tribunal consisting of Mr. Fortier, Dr. Nikken and Dr. Tawil rendered a decision confirming jurisdiction in the ICSID case Duke v. Peru. The case originated from the Peruvian government's privatization of Electroperu, the largest state-owned electricity generation company in Peru. In order to privatize Electroperu, Peru first unbundled Electroperu into several smaller companies, one of which was Egenor.
